1 - GENERAL
1.1 These general conditions of sale (hereinafter referred to as the "GTC") govern all relations between Bleu Solstice, whose registered office is located at 18 rue franklin 69002 Lyon, registered under the number SIRET 817 820 665 00021 and any person wishing to make a purchase of one or more creation(s) (as defined below) offered for sale by the Artist-Author in his sales space (as below defined) accessible on the website www.bleu-solstice.fr
2 - PRODUCT INFORMATION
2.1 - . All Bleu Solstice products offered for sale are created and manufactured in France in the Lyon workshop of the Artist-Author. These products are original cyanotypes. This is an alternative photography process involving a photosensitive surface reacting to ultraviolet light. If, by the artist's approach, the vast majority of cyanotypes are produced using the sun, some may have been created using a UV lamp for practical or technical reasons. Each cyanotype is a photogram obtained by contact with real plants, fresh or dried and pressed and/or photo negatives. They were made one by one, which gives them their original character. It is possible that the same flower, leaf, branch or any element used as an object is used on several cyanotypes. But the details, shadows, traces of the application of the photosensitive product with a brush, intensity of the color will always be different. No Solstice Blue photogram may be reproduced identically.
2.2 - The items present on the site and offered for sale are original and therefore all unique. The sale of a product immediately means that it is out of stock. The online store management tool will automatically indicate its unavailability. The Article, although indicated as unavailable, may remain visible on the store until the Artist-Author deletes its reference.
2.3 - Being artisanal products, the format of the paper or the photogram can know slight variations. In addition, each cyanotype, as the technical stage of rinsing assumes, was fully immersed in water for several minutes. Although every precaution is taken during this step, it is possible that small spots of yellow, green or blue color appear on the back of the cyanotype. This is simply the dissolution in water of the photosensitive product (purpose of this rinsing step) which may have been redeposited on the paper. Appearing on the back of the product, these possible traces, in the judgment of the Artist, in no way interfere with the front and therefore the visible part of the cyanotype. These imperfections are due to the artisanal character of the creations and of the very process of the cyanotype.
2.4 - The photographs presented on the sales area are the real shots of the items. Some details, shades, tints may, through photography and the screen, differ from reality.
The photographs and texts illustrating the articles are given for information only and do not enter into the contractual field. Therefore, although represented on the site with the greatest precision, the photos and texts may contain errors. In this case, the responsibility of the Artist-author under the brand name Bleu Solstice cannot be engaged.
3 - PRICE
3.1 - The prices are indicated in euros including VAT. The prices indicated do not take into account the postage and packaging costs which will be invoiced in addition and will be specified to the customer during the final validation of his order.
3.2 - In the event of an order to a country other than metropolitan France, customs duties or other local taxes or import duties or state taxes may be payable by the Customer. These rights and sums are not the responsibility of the Artist-Author. They will be the responsibility of the Customer and are his full responsibility, both in terms of declarations and payments to the competent authorities and bodies of the country. The Artist-Author advises the Client to inquire about these aspects with the local authorities.
The products remain the property of the Artist-Author until full payment of the price.
4 - CONDITIONS OF REALIZATION OF AN ORDER
4.1 - Prior to placing an order, the customer must register on the website and create a customer account by providing all of his personal information necessary for the registration and processing of his orders.
The creation, use and access by the Client to his Client account – recalled below – are governed by the conditions of use of the website, the terms of which the Client declares to accept, without restriction or reservation.
The Customer's e-mail address serves as an identifier (login). On the other hand, the Customer chooses his password, which he is responsible for changing regularly, in order to guarantee the security of his Customer account.
The Customer provides his delivery and billing addresses, which he can modify at any time, prior to placing the order. Once the Customer acknowledges receipt of a registration confirmation email to his email address, he has his Customer account on the website www.bleu-solstice.fr giving him access to the online sales area.
The Client guarantees the accuracy, sincerity and reliability of the information recorded on his Client account. It is therefore up to him to modify at any time and as soon as possible any change concerning him by logging into his Customer account.
The Artist-Author cannot be held responsible for the contact details or incorrect information of the Customer, in particular if they have an impact on the delivery of the products. In the event of erroneous or misleading information on the Customer's delivery details, the Artist-Author reserves the right not to deliver the order.
4.2 - To place an order, the customer selects the creation(s) he wishes to buy by clicking on his/their description sheet. Each piece being unique, the quantity of the same product cannot be greater than "1". He then click on the “Add to Cart” button. Each new creation added to his basket is indicated to the Customer in the summary of his Order.
The Customer may at any time modify or delete all or part of his order.
To finalize his order, the Customer must click on “finalize my order”.
He must then identify himself by connecting to his Customer account by clicking on the link “already a customer?”, if necessary he will have to create his account by clicking on the “register” button then follow the instructions of the site.
If the customer is already connected to his account, he is then automatically directed to the billing page on which he is responsible for checking, completing and validating the information mentioned there. The delivery address is, by default, the billing address, it may however be different, it is up to the Customer to specify it and provide a specific delivery address.
4.3 - The Customer can, from this stage, choose the delivery method proposed for sending his Order. Delivery costs are specified and calculated on this page.
By clicking on the "Finalize my Order" button, the Customer is directed to an "Order Summary" page presenting the nature, quantity and price including VAT of the creations he has selected, the various fees that may be applicable, as well as the different payment methods available.
To continue with the Order process, the Customer must read these T&Cs and accept them by ticking the box “I have read and accept the terms and conditions of sale”.
Before the final validation of his Order, the Customer can check the details of his Order, its price including tax and the applicable fees.
The Order will only be carried out from the validation of its payment by the Customer, by paying by credit card, on the secure platform....
4.4 Once the Order and its payment have been validated, the Customer receives an e-mail from the Artist-Author under the name Bleu Solstice presenting a summary of his entire Order, accompanied by a payment receipt. .
4.5 - In the event that the creation, for whatever reason, cannot ultimately be sold and shipped, the customer's order will then be automatically cancelled.
The Customer will then be immediately informed of the cancellation of his Order by e-mail and no sum will be deducted from the means of payment used.
4.6 - The Final Customer has the possibility of canceling his order, and this, until the moment when his order is taken care of by the carrier responsible for carrying out its delivery.
After this support, the cancellation of the Order will be carried out within the framework of the right of withdrawal of the customer, under the conditions and methods defined in article 5 of these GCS.
The cancellation of his Order by the customer will give rise to the full refund of all the sums paid by the latter at the time of the realization of his Order, delivery costs included by means of a credit on his bank card.
4.7 - In accordance with the provisions of Article L 121-20-3 of the Consumer Code, the Products ordered are delivered within the time limits indicated on the site, and within 30 working days of the order. The average delivery time is 5-10 days. It is indicated for information only and does not constitute a commitment.
5 - RIGHT OF WITHDRAWAL
5.1 - Under the provisions of Articles L.121-20 and following of the Consumer Code, the Customer has a period of 14 clear days to withdraw, without having to justify any reason, from the date of receipt of his order. Shipping and return costs will be borne by the Customer. The product must be returned by post in its new condition and its original packaging, accompanied by its invoice to the head office at 1 rue de l'ancienne préfecture 69002 Lyon.
The refund will be made by crediting the customer's bank card, within 15 days of receipt of the package. If the product is damaged, it will not be exchanged or refunded.
6 - RESPONSIBILITY OF THE ARTIST AUTHOR
6.1 - The Artist-Author guarantees the Customer the proper execution of the Order placed by the Customer, respecting the announced shipping times.
6.2 - The performance of the Artist-Author's obligations hereunder is suspended in the event of the occurrence of a fortuitous event or force majeure which would prevent its performance. The Artist-Author will notify the Client of the occurrence of such an event as soon as possible.
7 - INTELLECTUAL PROPERTY RIGHTS
The brand, domain name, logo, products, images, photographs, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of the Artist-Author. No assignment of intellectual property rights is made through these T&Cs. Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited and liable to prosecution.
8 - PERSONAL DATA
8.1 - The Artist-Author attaches great importance to the protection of personal data and wishes to assure the Customer visiting his sales area and the website that his privacy is protected. This article aims to inform the Customer of the processing of personal data concerning him, that is to say data allowing him to be identified, directly or indirectly, as well as his rights with regard to this processing.
The Final Customer is informed that the conclusion of a creation order from the Artist-Author, via the latter's Sales Space accessible on the Website www.bleu-solstice.fr gives rise to the collection and processing automated by the Artist-Author of the Client's Personal Data processing carried out in accordance with the Personal Data Regulations.
The Personal Data thus collected and processed are, in particular, the following:
All the information provided by the Customer when placing the order (Names, first names, postal address, e-mail address, delivery details, billing details, telephone details, etc.); Information relating to any interactions between the Artist-Author and the Client.
The purpose of the collection of Personal Data by the Artist-Author is to enable the management and monitoring of Orders.
8.2 - In accordance with the Personal Data Regulations, the Customer may oppose and/or delete and/or limit and/or withdraw his consent to all or part of the processing of his personal data carried out in the context of orders for legitimate reasons;
Rectify and/or update their Personal Data processed in the context of orders;

The artist-Author under the brand name Bleu Solstice undertakes not to disclose the personal information of customers to a third party.
8.3 - The Customer expressly acknowledges that entering any username and password constitutes proof of his identity and expresses his consent to all operations that will be carried out on the sales space and/or the Website following his identification. The Customer must take care to keep his e-mail address valid during the period of his registration on the Website at the risk of no longer being able to access it, in particular in the event of loss of his password. The Client's Account is strictly personal and therefore cannot be transmitted, by any means whatsoever, to a third party, even free of charge.
The End Customer expressly accepts that the automatic registration systems of the Bleu Solstice website are considered as proof:
The use of his username and password, and the dates and times of connection. Content recorded by the Customer in his “My account” space,
The nature, substance, date and time of all correspondence between the Client and the Artist-Author exchanged using the website or the tools offered on the website.
8.4 - The Artist-Author cannot be held responsible for any prejudice that the Client may suffer as a result of the use by a third party of his username and password. In the event of loss, misappropriation or fraudulent use of all or part of his username and password, the Customer must immediately apply the procedure prescribed in the Conditions of Use of the Website.
These stipulations are expressly considered to be substantial between the Client and the Artist-Author.
9 - LAWS
For consumer information purposes, the provisions of the Civil Code and the Consumer Code are reproduced below:
Article 1641 of the Civil Code: The seller is bound by the guarantee for hidden defects in the thing sold which render it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have it. acquired, or would have given only a lesser price, if he had known them.
